Terms and Conditions for The Jason Motte Foundation Charity Auction

These terms and conditions (the “Terms and Conditions”) govern any participation in this charitable auction (the “Auction”).  By bidding in the Auction, you expressly agree to be bound by these Terms and Conditions.

  1. Auction Proceeds
    Proceeds from this auction will benefit The Jason Motte Foundation to continue their efforts of funding cancer research, projects and/or programs.
  2. Ineligible Bidders
    Employees of The Jason Motte Foundation are excluded from taking part in the Auction.
  3. Age Requirement
    All bidders must be at least 18 years-of-age.
  4. Legal Status of Bids
    Each bid placed will constitute a legal offer, which, on acceptance by The Jason Motte Foundation, will form an agreement which will be binding on behalf of the individual placing the bid.
    All bids are binding and valid until payment for the item(s) have been received.
  5. Bidding Process
    Individuals placing a bid for this Auction must register an account with WordPress and enter their bid amount.
    All bids are in US Currency amounts.
    All bids must be received by midnight (CST) on the closing date of the auction.
    The winning bid in the Auction will be the highest bid that meets any conditions which may be applicable.
    The winning bidder will receive a confirmation email informing them they were the highest bidder with details on providing shipping information and making payment.
    If there is an issue with the winning payment, The Jason Motte Foundation reserves the right to offer the item(s) to the next highest bidder.
    The Jason Motte Foundation reserves the right to close the Auction early or to extend it at any time and at its discretion.
    If the Auction is cancelled for any reason and subsequently re-activated, all previous bids will lapse and bidding will recommence.
    If there is a dispute between bidders, The Jason Motte Foundation is under no obligation to become involved in such a dispute.  The Jason Motte Foundation, its officers, employees and agents are hereby released from any claims, demands or damages arising out of or in connection with any such disputes.
  6. Auction Items
    Items bought through the Auction are non-refundable and non-exchangeable.
  7. Payment
    Full payment details will be provided to the bidder when the auction is over.
    Payment is must be received within five (5) business days from the conclusion of the Auction.  Payment must be made via credit or debit card via PayPal.
    Unless otherwise agreed upon by The Jason Motte Foundation, no item(s) will be shipped until full payment has been made and all cleared funds have been received.
  8. Liability
    The Jason Motte Foundation ensures the information and material on this website are correct and complete, and does not accept liability for any errors in or omissions from these Terms and Conditions.  The Jason Motte Foundation will make reasonable efforts to correct errors and omissions as quickly as practicable after being notified of them.
  9. Personal Information
    All personal information will be held confidentially by The Jason Motte Foundation and will only be used or disclosed to a third party if such use or disclosure is required for the purposes of delivering the items to the winning bidder or as otherwise instructed by the individual.
  10. Release/Agreement
    Access to and participation by you in the Auction is confirmation that you have read and accept the above Terms and Conditions.
